2.7.6.2.1.
Drafting and submitting to the Cabinet of Ministers of Ukraine a draft law proposing to amend the Budget Code of Ukraine, specifically by:
1) amending subclause “c” of Clause 7 of Part 1 of Article 87 of the Budget Code of Ukraine to the effect that expenditures out of the state budget include expenditures for the pursuit of higher education by individuals who earned the right to obtain a higher education at the expense of the state budget (including on the conditions of a government contract) on a competitive basis; the allocation of expenditures among institutions of higher education shall be carried out according to the formula developed by the Ministry of Education and Science and approved by the Cabinet of Ministers of Ukraine;
2) amending Clause 46 of Section VI “Final and Transitional Provisions” of the Budget Code of Ukraine with respect to the list of parameters of the formula of allocation of state budget expenditures for higher education among institutions of higher education;
3) providing for an exhaustive list of cases of allocation of expenditures out of the state budget and local budgets for the funding of academic and engineering research and projects without the use of competitive processes.

За інформацією, наданою Міністерством освіти і науки України (далі –МОН) ним було розроблено та подано Міністерству фінансів України пропозиції щодо проєкту Закону України щодо внесення змін до Бюджетного кодексу України, зокрема до підпункту “в” пункту 7 частини першої статті 87 (Лист МОН № 1/16496-24 від 11.09.2024). У відповідь отримано лист Мінфіну, в якому останній на підставі ознаки технічних змін не підтримав пропозиції МОН (лист Мінфіну від 24.09.2024 № 07010-07-5/27575) (див. відповідні файли у Ключових джерелах оцінки).
Водночас, надіслані Мінфіну пропозиції МОН щодо проєкту Закону України щодо внесення змін до Бюджетного кодексу України не можуть вважатися розробленням законопроєкту, як те вимагається змістом даного заходу 2.7.6.2.1 Програми.
З огляду на це, враховуючи строки виконання даного заходу, визначені Програмою, Національне агентство з питань запобігання корупції констатує, що він є невиконаним.
Водночас, МОН зазначає, що "постановою Верховної Ради України від 20.03.2024 № 3611-ІХ прийнятий за основу проект Закону України про внесення змін до деяких законів України щодо фінансування здобуття вищої освіти та надання державної цільової підтримки її здобувачам (реєстр. № 10399), поданий Кабінетом Міністрів України. МОН супроводжує проєкт акта до другого читання у Верховній Раді. Ухвалення акта передбачає необхідність подальшого внесення змін до Бюджетного кодексу, зокрема таких, що стосуються застосування формульного розподілу. Такі зміни будуть включати також заходи, передбачені п. 2.7.6.2.1".
