Implementing status

Progress/Result of implementation:

According to the Ministry of Digital Transformation: “Currently, the Diia Portal enables the state registration of the establishment of a limited liability company (LLC) operating based on a model statute for LLCs. No other business registration services where ultimate beneficial owner verification can be conducted electronically exist or are provided under Ukrainian legislation.

The information is verified through electronic information interaction with state electronic information resources as follows:

- from the Unified State Demographic Register via the unified information system of the Ministry of Internal Affairs: data on surname, first name, patronymic (if any); date of birth; document type; series (if any) and document number(s) that confirm identity and citizenship, including but not limited to the passport of a citizen of Ukraine for traveling abroad; unique entry number in the Unified State Demographic Register; place of residence;

- from the State Register of Individuals – Taxpayers: data on the taxpayer's registration number.

If new business services are introduced through the Diia Portal, once the technical capability to implement such a service is ensured, appropriate amendments will be made to the Resolution of the Cabinet of Ministers of Ukraine (CMU) No. 976 of September 12, 2023.”

The CMU Resolution No. 976 of September 12, 2023, “Certain Issues of Automatic Verification of Information through the Unified State Web Portal of Electronic Services using Information from the Unified State Demographic Register and the State Register of Individuals – Taxpayers,” provides for two stages of implementing such verification:

1) introduction of automatic verification for LLCs operating under a model charter and currently registered through Diia;

2) ensuring the technical capability for the registration of other types of legal entities through Diia and the automatic verification of their ultimate beneficial owners.

Currently, only the first stage has been implemented, and automatic verification is conducted only for LLCs operating under a model charter. In light of this, the measure is considered partially completed.
