The Ministry of Internal Affairs of Ukraine (MIA) has enabled an analytical study, the subject of which is the prospects for improving the human resource policy and changing the remuneration terms of police officers to increase the police service’s competitiveness in the labor market.
Based on the monitoring results, it was established that the report is generally highly persuasive in terms of defining the problem, as it is based on objective data. At the same time, the proposed ways of solving the problem do not include any proposals concerning funding sources or additional expenses for police officers’ salaries, as required by subparagraph 2.1.6.3.6 of Appendix 2 of the State Anti-Corruption Program for 2023–2025.
Given the above, the measure may not be treated as fully implemented.
The MIA proposed to exclude from the subject of research the question of the sources of covering additional expenses for salaries of police officers (letter No. 5931/03/38-2024 of April 15, 2024).
At the same time, the options offered in the study for solving the problem of the lack of an effective model of remuneration for police officers, which is articulated in the Anti-Corruption Strategy for 2021–2025, invariably require either an increase in the expenditures of the State Budget of Ukraine or a decrease in budget revenues.
It should be noted that under Part 3 of Art. 91 of the Verkhovna Rada of Ukraine Rules of Procedure, when introducing a draft law or another act whose adoption will change budget indicators (budget revenues and/or budget expenditures), the introducing entity is obliged to add a financial and economic justification (including relevant calculations). If such changes in budget indicators involve a decrease in budget revenues and/or an increase in budget expenditures, a draft law or another act should be accompanied by proposals for changes to legislation regarding the reduction of budget expenditures and/or sources of additional budget revenues to achieve budget balance.
Similar provisions are included in part 1 of Art. 27 of the Budget Code of Ukraine, as well as subclause 3 of clause 3 of § 70 of the Cabinet of Ministers of Ukraine’s Rules of Procedure.
At the same time, the lack of proposals to reduce budget expenditures and/or find sources of additional budget revenues was the key factor in the failure of previous attempts to solve the problem through regulatory and legal measures, as evidenced by the relevant opinions of the Ministry of Finance and the Budget Committee of the Verkhovna Rada of Ukraine.
In view of the above, even though the MIA’s reference to provisions of laws and regulations that determine that expenses for the salaries of police officers should be financed exclusively at the expense of the state budget reflects reality, it does not eliminate the need to find sources for covering additional costs for the salaries of police officers.
At the same time, to settle the issue of the full implementation of the task defined by subparagraph 2.1.6.3.6, problem 2.1.6, clause 2.1, Section II of the State Program, the MIA, together with the National Police of Ukraine and the National Agency on Corruption Prevention, held an additional discussion of the state of implementation of the specified measure via videoconferencing on June 19, 2024.
