2.1.1.2.1. Conducting the assessment of conformity of the candidates for positions of members of the High Council of Justice to the requirements of professional ethics and integrity

The measure is aimed at achieving ESR:

2.1.1.2. The integrity of new members of the High Council of Justice and the High Qualification Commission of Judges of Ukraine is evaluated by an independent committee, and the current members of the High Council of Justice have been evaluated for conformity to the requirements of integrity and professional ethics; the new members of the High Council of Justice and the High Qualification Commission of Judges of Ukraine meet these requirements; the issue of dismissal of members who fall short of these requirements has been considered

The opinions on the conformity to the criteria of professional ethics and integrity in respect of each candidate for a vacant position of a member of the High Council of Justice have been issued to the appointing agencies and made public.

Implementing status

Progress/Result of implementation:

The measure has been completed, particularly from January 11 to 13, 2023, when the Ethics Council conducted interviews with candidates for vacant positions as members of the High Council of Justice from the All-Ukrainian Conference of Prosecutors. The decision on the compliance or non-compliance with the criteria of professional ethics and integrity of each candidate was published on the official website, along with the Ethics Council’s Decision No. 2 of January 20, 2023, “On the Approval of the List of Candidates Recommended for Election by the All-Ukrainian Conference of Prosecutors for the Position of Member of the High Council of Justice.”

On March 16, the Ethics Council, based on the results of interviews, adopted Decision No. 15 “On the Approval of the List of Candidates Recommended for Appointment by the President of Ukraine to the Position of Member of the High Council of Justice,” as well as decisions on the compliance or non-compliance with the criteria of professional ethics and integrity of the candidates for the position of Member of the High Council of Justice from the President of Ukraine.

From April 3 to April 7, 2023, the Ethics Council conducted interviews with candidates for the position of Member of the High Council of Justice from the Congress of Representatives of Higher Legal Educational Institutions and Scientific Institutions, based on which the decision on the compliance or non-compliance with the criteria of professional ethics and integrity of each candidate was published, along with the Ethics Council’s Decision No. 30 of April 28, 2023, “On the Approval of the List of Candidates Recommended for Election by the Congress of Representatives of Higher Legal Educational Institutions and Scientific Institutions to the Position of Member of the High Council of Justice.”

On October 23, 2023, the Ethics Council adopted a decision on the compliance with the criteria of professional ethics and integrity of the candidates for the position of Member of the High Council of Justice from the Congress of Representatives of Higher Legal Educational Institutions and Scientific Institutions.

Six candidates for the position of Member of the High Council of Justice were recognized as meeting the criteria of professional ethics and integrity.

On June 19, 2024, the Ethics Council adopted a decision on the compliance with the criteria of professional ethics and integrity of candidates for appointment by the President of Ukraine to the position of Member of the High Council of Justice.

Currently, the total number of members of the High Council of Justice is 17 out of 21. Four positions remain vacant in the High Council of Justice: two from the President of Ukraine and two from the Congress of Advocates of Ukraine.
