Відповідно до чинних нормативно-правових актів Держводагентство не є організатором та учасником електронних аукціонів. Позиція органу полягає в тому, що впровадження на постійній основі електронних аукціонів щодо такого обмеженого спільного ресурсу, як поверхневі водні ресурси, з урахуванням проведених аналітичних досліджень недоцільно.
З огляду на вказане у проекті акта Кабінету Міністрів України щодо внесення змін до Державної антикорупційної програми на 2023-2025 роки запропоновано виключення Держводагентства з числа виконавців заходу.
