2.5.3.3.2. Supporting the consideration of the draft law on amendments to the Code of Ukraine on Administrative Offenses and the Criminal Code of Ukraine pertaining to imposition of harsher liability in the urban development sector in the Parliament of Ukraine (particularly if the President of Ukraine vetoes the draft law), particularly the Draft Law of Ukraine On Amendments to the Code of Ukraine on Administrative Offenses and the Criminal Code of Ukraine Pertaining to Imposition of Harsher Liability in the Urban Development Sector (registration number 5877 dated September 1, 2021), in the text of which (if adopted in its entirety) the concept of unauthorized construction has been aligned with Article 367 of the Civil Code of Ukraine

Mandatory verification of documentation submitted for the purposes of obtaining permits has been introduced and liability of an official for improper performance of duties in conducting such verification has been established; improvements have been made to legislation establishing criminal liability for offenses in the field of urban development

Зі змісту наданої Мінінфраструктури інформації вбачається, що виконання заходу не розпочато, оскільки Мінінфраструктури не надано інформації щодо здійснення заходів щодо супроводження законопроекту (реєстр. № 5877 від 01.09.2021). 15 грудня 2021 відповідний законопроект було прийнято за основу Верховною Радою України, що означає, що відповідний законопроект готується до другого читання більше 2 років.
За інформацією Мінінфраструктури: "Виконується. Подальше доопрацювання проекту Закону України “Про внесення змін до Кодексу України про адміністративні правопорушення та Кримінального кодексу України щодо посилення відповідальності у сфері містобудівної діяльності” (реєстр. № 5877 від 01.09.2021) можливе після підписання Закону України від 13.12.2022 № 2851-IX «Про внесення змін до деяких законодавчих актів України щодо реформування сфери містобудівної діяльності», який 19.12.2022 передано на підпис Президенту України".
Інформація щодо розробки окремого проекту закону з вказаної тематики від Мінінфраструктури не надходила.
