3.3.3.11. Measures to prevent the laundering of money obtained through corruption are determined based on the results of risk assessment and are duly implemented. FATF recommendations are being consistently implemented

3.3.3. The legislation governing the activity of the ARMA contains numerous gaps and corruption risks. Low effectiveness of the processes of transferring assets to ARMA for management to preserve their economic value, as well as the processes of combating and preventing money laundering

According to the information provided by the Ministry of Finance of Ukraine, the following normative legal acts have been adopted, directly or indirectly aimed at implementing the above measure:
- Resolution of the Government and the National Bank of Ukraine dated Sepmber 19, 2023 No. 1011 On Approval of the Methodology for Determining the Ultimate Beneficial Owner by a Legal Entity;
- Resolution of the Government dated June 16, 2023 No. 662 On Approval of the Procedure for Supervision in the Area of Preventing and Combating the Laundering of Proceeds of Crime, Financing of Terrorism, and Financing of Proliferation of Weapons of Mass Destruction over the Activities of Primary Financial Monitoring Entities, State Regulation and Supervision of which is carried out by the Ministry of Finance, the Ministry of Justice, the Ministry of Digital Transformation, dated June 13, 2023 No. 602 On Approval of the Procedure for Forming the List of Foreign Stock Exchanges (Regulated Markets) Subject to the Requirements for Disclosure of Information on Ultimate Beneficial Owners, dated February 14, 2023 No. 130 On Amendments to the Regulation on the Ministry of Finance of Ukraine;
- decree of the Government dated December 27, 2023 No. 1207-r On Approval of the Action Plan Aimed at Preventing and/or Mitigating the Negative Consequences of Risks Identified by the Third National Risk Assessment in the Area of Preventing and Combating the Laundering of Proceeds of Crime, Financing of Terrorism, and Financing of Proliferation of Weapons of Mass Destruction for the Period up to 2026;
- orders of the Ministry of Finance of Ukraine dated December 28, No. 465 On Approval of the Criteria for the Risks of the Laundering of Proceeds of Crime, Financing of Terrorism, and Financing of Proliferation of Weapons of Mass Destruction, registered with the Ministry of Justice of Ukraine on February 09, 2022 under No. 258/39314, dated December 09, 2022 No. 422 named Some Issues of Formation of Administrative Reporting by the Ministry of Finance of Ukraine as a State Financial Monitoring Entity in the Area of Preventing and Combating the Laundering of Proceeds of Crime, Financing of Terrorism, and Financing of Proliferation of Weapons of Mass Destruction, registered with the Ministry of Justice on December 22, 2022 under No. 1664/39000.
